FLDS too late, court says

The Utah Supreme Court said in a ruling released today that the FLDS waited too long to challenge state control and reformation of the United Effort Plan Trust. Here is the story, which I am continuing to update. Also, I will update this blog post with reaction throughout the day. Margaret Cooke, UEP Trust advisory [...]

Wisan’s response to FLDS

Here is the response from fiduciary Bruce R. Wisan to the FLDS’ request for emergency relief. Wisan’s petition was filed late yesterday afternoon with the Utah Supreme Court.

What Arizona wants

This document was tucked in a court filing in the UEP Trust case. I found it interesting as far as the breadth and depth of the request by the Arizona Attorney General’s Office to learn what has been going on in the Twin Towns. The list offers of pretty good summary of who, what, when [...]

Hainline dispute

Here is the police report from the recent property dispute in Colorado City that led to arrests of Matt and Genevive Hainline. According to the police report, Andrew Chatwin told officers that UEP Trust fiduciary Bruce R. Wisan is working to have Moccasin Judge Kalauli barred from overseeing any actions involving trust land.

Lindberg order

And when it rains it pours…Here is an order released today by 3rd District Judge Denise Lindberg on the UEP Trust situation. I have not had time to read it, but a brief scan shows she is granting the Arizona Attorney General’s request for a partial lift of the litigation stay. I assume that is [...]

Trespass case hearing on track

Here is a copy of an order I just received. A two-day hearing begins tomorrow in Kingman, Arizona, on the “claim of right” defense offered by Bruce Wisan and Jethro Barlow in their criminal trespass case. The judge apparently rejected a request that the hearing be continued. He also said, that depending on the outcome [...]

The silos

The latest property dispute in the twin towns is over grain silos that the FLDS say are part of the Bishop’s storehouse and have never been part of the UEP Trust. UEP Trust fiduciary Bruce R. Wisan leased the silos to David Stubbs and Shane Stubbs, both ex-FLDS members. The FLDS went to court to [...]

Wisan has questions, you have answers

The latest edition of the “UEP Trust Beneficiary Update” was distributed to residents of the twin towns a few weeks ago and showed up this week on the FLDS Texas website. Curiously, there aren’t any issues of the “Update” on the UEP Trust’s website, which would seem a logical place for the fiduciary to post [...]

Moccasin, Arizona

I spent Tuesday in Moccasin, Arizona, at the tiny justice court where a hearing in the trespass case of Bruce Wisan and Jethro Barlow took place. Here is a video. Photos and story to follow in another post. httpv://www.youtube.com/watch?v=XbJfTh35gx8
